Kratom has received a lot of attention in Pennsylvania. At the legislative level, there have been efforts to regulate it, efforts to ban it, and efforts to influence federal law on the matter. But where does it stand now? Is kratom legal in Pennsylvania? Here’s what you need to know if you’re thinking of stocking up.
Is Kratom Legal in Pennsylvania?
Yes, if you’re looking to enjoy kratom in Pennsylvania, you’ll be glad to know that it is legal to manufacture, sell, or purchase. There are no current regulations or restrictions in place. In 2019, some Pennsylvania citizens lobbied to have kratom banned, but nothing ever came of this effort. That same year, Pennsylvania state legislators drafted a resolution urging the federal government to impose safe kratom regulations, but so far nothing has come of the resolution. Kratom remains unregulated at the federal level.
As part of the 2022 legislative session, lawmakers are considering a bill that would impose some modest kratom regulations in the state. The bill, HB 2357, seeks to introduce an amended version of the Kratom Consumer Protection Act (KCPA), a set of regulatory measures that have been introduced in other states like Utah, Arizona, and Georgia. The bill passed the House with almost unanimous support and is currently being reviewed by the Senate Health & Human Services department.
What the KCPA Would Mean for Kratom in Pennsylvania
The Kratom Consumer Protection Act was originally drafted by the American Kratom Association (AKA) with the goal of creating a safer marketplace. Among other things, the KCPA seeks to:
- Restrict the sale of kratom to minors
- Require clear and accurate product labeling
- Prevent the sale of kratom containing:
- Synthetic alkaloids
- Adulterants
- Contaminants
It’s important to note, however, that the version of the KCPA currently being reviewed by Pennsylvania legislators looks quite a bit different from the original version drafted by the AKA.
The original draft of HB 2357 contained all of the above stipulations. However, the bill has since been amended by legislators with many of the key provisions removed. No longer does the Pennsylvania bill specify that kratom must be free from synthetics or adulterants. State legislators have noted that Pennsylvania law already accounts for these types of restrictions.
The Pennsylvania bill does forbid the sale of kratom to minors (though the minimum age has been amended from 21 to 18). While the bill has not yet been made law, it appears to enjoy widespread bipartisan support.
Can You Travel Outside of Pennsylvania With Kratom?
Because kratom isn’t regulated or restricted at the federal level, there’s no law against interstate transport. You can freely travel across state lines with kratom in your possession; just be sure to keep it in its original packaging in case you get questioned.
However, while kratom is legal in Pennsylvania, it’s important to note that not all states are kratom-friendly. If you’re traveling to the nearby New England states, you’ll need to avoid bringing kratom products into Vermont or Rhode Island. Kratom is banned in both of those states, and you could face fines or even jail time if you’re caught in possession of any kratom product.

In addition, the original, unaltered version of the Kratom Consumer Protection Act dictates that kratom products should contain no more than 2% of the alkaloid 7-hydroxymitragynine. While this rule has been omitted from the Pennsylvania bill, it’s still a good rule of thumb to follow when shopping for kratom. In high concentrations, 7-hydroxymitragynine may have adverse effects.
