Kratom in Nevada – An Update on the Ongoing Legal Battle

Kratom is legal in Nevada right now, but could that all change in the near future? The Nevada State Board of Pharmacy (the department that oversees pharmaceutical drugs in the state) recently called a public hearing to reconsider the legal status of kratom in Nevada. The hearing was scheduled for April 14th and sought to list kratom as a Schedule 1 Controlled Substance. The listing would be made in the form of an amendment to the Nevada Administrative Code (NAC). 

 

Why a Schedule 1 Listing Would Be Disastrous for Kratom Customers

A Schedule 1 listing would be disastrous for kratom in Nevada because it would immediately render kratom illegal throughout the state. This, in turn, could set a precedent that would encourage other states to take similar steps. The American Kratom Association (AKA) has been monitoring the situation closely and encouraging kratom supporters to contact Nevada state officials to oppose the amendment.

The federal drug schedules were outlined and defined by the Drug Enforcement Administration (DEA) in 1970 as part of the Controlled Substances Act. There are five schedules in all, and Schedule 1 is reserved for those drugs considered the most dangerous and least beneficial. 

According to the DEA: “Schedule I drugs, substances, or chemicals are defined as drugs with no currently accepted medical use and a high potential for abuse.” Schedule 1 drugs include heroin, ecstasy, and cannabis (though the cannabis designation has proven especially controversial in recent years). 

If kratom were to be listed as a Schedule 1 Controlled Substance in Nevada, residents would be unable to legally purchase or consume it within the state’s borders. Nevada would treat kratom just as the federal government treats cannabis and heroin—this despite the fact that, pharmacologically, kratom has more in common with coffee than with any substance currently listed under Schedule 1. What’s the Current Status of Kratom in Nevada

It appears that the passionate advocacy of the AKA and kratom supporters has paid off, at least for right now. On April 6th, it was announced that the Board of Pharmacy had removed the kratom hearing from its agenda, reportedly in response to the AKA’s legal efforts and the kratom community’s outpouring of public comments on the issue. 

The Board of Pharmacy cannot raise the issue again for scheduling consideration in 2022, but as there are still members of the board who oppose kratom in Nevada, supporters should still be diligent about fighting to preserve their rights into the future.

Kratom may be legal in Nevada, but the battle isn’t over. As we speak, other states are considering anti-kratom initiatives of their own. In Tennessee, for example, legislators are actively considering HB 2043, which would ban kratom throughout the state. Other states, like Texas, Ohio, Michigan, and Hawaii are considering kratom bans or restrictions of their own. And other states—like Alabama, Arkansas, Indiana, and Rhode Island—have already banned kratom entirely. 

In other words, this is an issue that’s being played out in states across the U.S., and kratom supporters should be ever-diligent about resisting these initiatives not only in Nevada but in other parts of the nation as well. The more states that restrict kratom, the more states that are likely to follow suit in the future. Supporters of kratom in Nevada can get involved at the grass roots level by supporting the work of the AKA and by writing to legislators in states where kratom restrictions are being pursued.
